Hate crime laws are stupid and unconstitutional because they levy harsher penalties for the same crime depending on who committed it and why. Whether a victim has the crap beat out of them because of their race, religion, sex, or whatever should have no bearing on how harshly the offenders are punished.
A crime is a crime and if you want to make the punishment more harsh for all who murder, rape or commit assault, fine, but don't make unconstitutional laws that distribute penalties inequitably based on something subjective and you don't punish one group or race more harshly than another simply because they expressed hate for another group or victim because then,
you are basically making hate a crime.
I will repeat that for those caught sleeping.
Hate crime laws make hate a crime which is insane. Think about that, you are essentially making a feeling a crime which is absurd and why should hating someone be a crime and what's next, if you don't like someone you can be arrested for it?
Why should crimes committed due to hate carry any more of a penalty than crimes committed out of indifference for the victim? The victim is just as assaulted, raped or dead so why should the penalty for the crime be any more or less depending upon motive?
Sentencing based on whether someone hated someone else makes about as much sense as prosecuting someone based on the type of pants they wear and would you really care if your assailant was wearing Khaki or Camo while you are laying their bleeding to death???
