Sounds like they also shot themselves in the foot by producing needlessly detailed privilege logs.

FRCP 26 provides:

(5) Claiming Privilege or Protecting Trial- Preparation Materials.
(A) Information Withheld. When a party withholds information otherwise discoverable by claiming that the information is privileged or subject to protection as trial-preparation material, the party must:
(i) expressly make the claim; and
(ii) describe the nature of the documents, communications, or tangible things not produced or disclosed — and do so in a manner that, without revealing information itself privileged or protected, will enable other parties to assess the claim.



Typical information in a privilege log would be like:


Bates No. Date Description Author/Title Recipients/Title Basis For Privilege (attorney-client communication and/or attorney work product)



The description would be something like "memo regarding New Black Panther case" or "memo regarding telephone call with John Smith" or "memo regarding legal research"


To give away the details of the contents of the communication in the privilege log defeats the purpose of claiming privilege: avoiding disclosure of the document to the adversary.

The problem is that the relevant statute provides the Attorney General with the authority to enforce Civil Rights Commissions subpoenas, and he is instead obstructing compliance with the subpoena.

42 USC 1975a, in pertinent part:

(2) Power to issue subpoenas The Commission may issue subpoenas for the attendance of witnesses and the production of written or other matter. Such a subpoena may not require the presence of a witness more than 100 miles outside the place wherein the witness is found or resides or is domiciled or transacts business, or has appointed an agent for receipt of service of process. In case of contumacy or refusal to obey a subpoena, the Attorney General may in a Federal court of appropriate jurisdiction obtain an appropriate order to enforce the subpoena.

In May 2009, the Obama/Holder Justice Department dropped charges in a
voter intimidation case against Malik Shabazz, a leader of the
New Black Panther Party, despite having already won a summary judgment
against him, and his New Black Panther Party colleagues King Samir Shabazz
and Jerry Jackson who were video-taped outside polling place in Philadelphia intimidating
voters as they arrived on election day, 2008. In July 2009, when
Congress began looking into the matter, someone named Malik Shabazz
visited the private residence at the White House.
When news of the visit was released under the auspices of transparency, the
White House denied that the Malik Shabazz on the visitor’s log was the
same Malik Shabazz involved in the New Black Panther
voter intimidation case.
