Re: Frame bent on my new Titan

Hey man Im sorry that happened to ya. Do not let the insurance company pull the frame!!! This is an issue that you may consider getting a lawer for. I would take them to court (if warranted) for a new pick up truck. usually Insurance companies will list the vehicle as totaled if there is any bending on the frame.

DO NOT LET THEM PULL IT!!!

The consensus appears to be that I am basically stuck with a new Truck with a bent (collision) and then essentially re-bent (pulled) frame. Apparently, there is some kind of limited recourse available through small-claims court in the state I live in, provided I can argue the case effectively that the fair-market value of the truck--for resale or trade-in purposes--has been effectively diminished. Which, of course, it has.

So I dunno. Bum deal.
I got my Titan, May 31 2004, on June 14 2004, I was rearended by a lady who was driving while talking on a cell phone, she was moving in excess of 42 mph( according to police), I was stopped at a red light. I went to see a lawyer and he told me that In Texas, your only recoarse is to let them try and fix it. They strightened the frame and it drives perfect, so it can be done, but there are some minor problems that I should have taken back untill they got them all fixed.
The lawyer told me that in Texas, the diminished value, can not be used, but if it can in your state, I would go for it.
Good luck, and inspect it good before you accelp it back.

The next that I am in an accident, that is not my fault, I'm going to fall out on the ground, kicking and screaming for an ambulance, that way I may can recoup the money I will lose when I sell my truck.

Re: Frame bent on my new Titan

I am wondering if any of you guys have used 'collisionclaims.com' and had good results with recouping vis a vis diminished value claim(s) with them. Based on some advice from this thread, I went to their website and put in all the information about the accident and damage to my titan, and they say if I give them $295.00 they'll do a full inspection and give me some documentation I can use to recoup the diminished value from Farmers. Any thoughts on this?

There doesn't seem to be any REAL evidence that it'll be money well-spent. Just their claims that it will work, etc.
