I need help! What should my friend do? TITAN PROBLEMS!!
Hey guys, I appreciate all the help!
My friend just bought a TITAN LE CC 4X2. It has just over 1000 miles and he has already got almost a dozen problems with it!
1. Rattle from dash (BAD RATTLE)
2. Sqeek-like moisture sound coming from under carpet (driver side front and rear).
3. Dealer-caused swirl marks due to overspray of bed liner on rear quarter pannel (presumably from bed liner).
4. Door handles have a wierd "line" defect to them.
5. Front driver quarter pannel rattles when doors close.
6. Rear passanger door does not close properly
7. Bed liner pealing (BAD!!)
8. Paint chipping on hood and tailgate
9. headlight "clear coat" chipping off in corners (BAD!!!)
10. Radio problems
12. Rockford Fosgate sterio causes rear door rattle.
13 Pasanger side seat power adjustable -BROKEN.
14. Driver side window and lock button housing loose and poping up (not flush with door)
My truck is almost flawless, but his is terrable... what should he do. He is sick that he spent 33 grand on the truck and finds the problems. Would any of this qualify for lemon law? I really hate to see him have this many problems.
Thanks,
Josh
Take it to the dealer immediately with this list of problems and make it their headache. A lot of states will not let you file lemon law unless the vehicle has a reoccuring problem that the dealer is able to duplicate and fix THREE times without a final and complete fix of the problem as the end result. In otherwords you have to at least provide the dealer an opportunity to fix the problem. You cannot typically just file as a lemon with an assortment of problems as your friend has.
Take to a dealer and see if they fix it. See as he has that many problems it may be hard to solve them all at the same time. Since none are something you can easily fix, I would take a list to the dealer where it was bought, and tell them to fix it. Before signing the paper work check that each issue was addressed on the work order. Also call Nissan first to see what they say. Nissan may have a in house way of correcting the problem before the lemon law kicks in. I don't know the Lemon laws that well but most of them are that a certain part has been replaced 3 times. Talk to a lawyer in your state to find out the Lemon Law requirements.
Although this might seem obvious, test drive and inspect the vehicle before you take delivery. Don't sign anything until defects you find are fixed. This won't help for things that break after you buy it, but in this case, many of these items should have been readily apparent. Or just walk away, or buy a different vehicle or from another dealer.

The telephone and cable companies out here have better customer service than Nissan's Customer Service line. Nissan has an "Arbitration Department" that deals with BBB AutoLine filings. I am required to participate in BBB AutoLine in North Carolina before I can sue under the NC New Vehicle Warranties Act (Lemon Law).
The Arbitration Department said "we'll fix your truck and make a payment for the month it's been in the shop if you drop the AutoLine and sign a bunch of paperwork that you won't sue us". Whoopdie-sh*t. If Nissan truly wanted to fix my truck, they would have done so already. It's been to the dealer 4 times now for the same problems and they've had the truck for almost a month, and counting. Customer service has been "involved" since day one. A check for $500 just ain't gonna do it.
We purchased the truck on May 4th. Arbitration is scheduled for July 7th.

If he is that unhappy with the truck he should just trade it in on another one. Thats what I would do, sell it or trade it and go get a new one!
I have had some problems with mine but it's all small stuff that will get fixed. no major problems at all. The truck just runs great!
just my thoughts.
Do you know what kind of "hit" someone would take, trading in an almost new vehicle? You'll quickly realize how much you lose the moment you drive it over the curb. The price of buying a new vehicle. Every new vehicle I've bought, and I never buy "used", I think about the thousand or two or three dollars I "lost" when I leave the dealership. To me it's worth it to have a new vehicle, but trading it in just to get rid of some problems may not be the best way to go financially. Who knows, the next one you get may have the same troubles.

Does anyone have any pictures of this mess of a truck? If it was mine, I would document all of the issues so that I would have some ammunition when I contacted Nissan for resolution.

Ken....Based on my own problems with new trucks in the past, I have owned 7 new trucks in the past years alone. When I have one that has so many problems, that even when there are fixed they go out again and again. I'm talking about rear Ends, trans, motors, wirring etc. A few of these trucks I should have dump way sooner then I did! I hung onto them to long and when I did sell them I took a lot harder hit then if I had gotton rid of them alot sooner. Plus people do not like to buy a truck that has had alot of repairs done to it, and looking to spend 20k or 30k on it.
If you are have alot of problems with your truck that can not be fixed or keep happing it is smart to get rid of it while it is still worth alot and start over! just my thoughts on this.
