This Is Really Getting Ugly!

Well you all are not going to believe this!!!
I was looking over the work order on my truck.
The dealer had my truck in the shop for a total of 42 CONTINUOUS DAYS! This time.
The repairs that they were making should not have taken more they two weeks max in my opion!
Last night I was looking over my paper work on this and I could not believe what I FOUND!!
Not only was my truck Not Done when I picked it up after 42 days!
THEY PUT ABOUT 800 HUNDERED MILES ON MY TRUCK!!!
From the day that I had brought it into them!!!
So I right away drove right down there to talk to them about this!!!
The GM said to me that I had put all those miles on my truck during the time they had it, When I only took it for 3 test drives in that time frame. I told them that, THAT IS NOT GOING TO FLY!!! I took my truck out for a total of about 15 min. at a time and brought it right back to you so DONT GIVE ME any of THAT SH*T!
I want to know right now WHO was JOY RIDING IN MY TRUCK!!!
The GM said we do not do that around here! I said to him then Whats the Reason for all these Miles Put on my Truck! He said that he did not no that my truck had been here this long, He called in the service manager and we all went over it.
The Service Manager said to us that he let AT LEAST One of his EMPLOYEE'S Take MY TRUCK HOME FOR THE WEEKEND!!!
And that he can not ACCOUNT for all the miles on my truck!!!! I told the GM that he better find OUT who ALL is ACCOUNTABLE for This!!!
I gave him one day two get back to me on this.
You know this is really sad! I looked over all my paper work and counted all the days that this shop has had my truck this year and it adds up to 82 days!!! I have only had the truck sense FEB. I have made more then 2k in payments during all this time without the truck! And it gose in for some simple repairs and a radio! It comes out 42 days latter and with SCRATCHS all over the Dash and not everything fixed and done right! On all the work orders I pionted out to them that on any of them they DO NOT SHOW any out going miles on my truck! only incoming miles!! It is this way for all the work orders that they given me! NO OUT GOING MILES! They seem to have NO Concern for getting my truck fixed fast and fixed right! They keep my truck and LET there Employees take it home!!!
Who knows what they did or how they abused my truck! I'm stuck with some little compac car and they are driving my truck WHO KNOWS Where! Causing damage more then likely!
While I sit and make all these payments on a truck that the dealer has had as long as me!!
I have already been to the police on this today. They said it is a civil action not a criminal one. I do not know how they can get away with this!!

This really SUCKS!!

They can't get away with this. I recommend reading the lemon law booklet that came with your truck. I think you'll find some remedies available to you in this situation. Do not threaten litigation, but politely explain that though you don't want to get lawyers involved, you are willing to do just that should the need to present itself. Try and stay as cool-headed as possible but straightforward with your demands and transparent regarding the actions you will take it they fail to do everything within their power to fix this *unbelievable* situation.

Have you called Nissan Corporate yet? I can see their excuse
"We wanted to make sure the radio was fixed, so we had guys take it home.."

Wouldn't you just die if one day you say your truck go by with some greasy teen monkey driving it... LOL!

I would walk in and simply say "Looks like you guys just bought yourself a new demo truck for $xxxx (price you paid for it)".

It continues to amaze me at how crappy some of those dealers are out there. Man! Thank goodness I've gotten lucky. Good luck getting some payback for that..you definitely need to get not only reimbursed for the time you haven't had the truck (payments) but something else worth .35 a mile x 800 miles from the dealer.

dude I would SOOOO make them give me a new truck!!! now that seems extensive, but do they just depreciated your car like crazy. I woudl take the service managers name and his story that he let some one take YOUR car home, and go straight to NISSAN. the owner of the dealership is not going to take care of you---I would get on this asap

This does not fall under the Lemon law... What is does fall under is negligence and mal business practice. I would make them pay for all miles at .32 per mile, pay for work charged but not done or not done correctly at another shop (with a BBB good standing) They should also pay for hours you had to deal with them and if you had to pay for a rental...they should pay for that as well. If they do not go for it....get a lawyer...you can sue for up to 3 times the damages..your lawyer will probably get 1/3 or a little more depending. More than likely they will give in it just depends when....when you ask...when your lawyer asks....when the judge tells them to.....

Also contact the BBB and see if they are members...if so file a complaint

Exactly what Mikedpych said. Go in determined to come out with your truck fixed or a brand new one with some extra options for free. This is BS and there is no way in hell they should be able to get away with this. Go after them who knows who else they have done this to and just let them get away with this.

BTW, you may want to take to the DA, this may very well be grand thief of your vehicle (even though it was returned).

Call the BBB Autoline at 800-955-5100.

When my dealer had my truck in for 33 days (continous), I complained to the BBB and had my truck lemon law'd. I got every cent back (including interest on my loan) minus $896 on depreciation (I had 2,896 miles).

The whole process took about a month.

Isn’t this criminal? 20,40 miles is excusable, but 800 miles sound like theft.

800 miles divided by 42 days = 19.04 miles kinda sounds like my commute back and forth to work everyday or a nice parts run for the shop

Sounds like you need to set up a table outside thier dealership and preach some of how your getting mistreated....I dont think I could have contained myself after they told me an employee took my truck home and they cant account for the miles,,,,OMG,,,,,,,,,,,,,,,,,,,POW
