The dealer is unraveling the deal for me. I'm getting back my '04 Nissan XE that I traded in. so we're back to squrare one. In the meantime, another dealer friend of mine has an '05 LE CC 4x4, loaded with everything except sunroof, nav, & sat. It only has 2500 (non-wrecked) miles on it. It was traded in on an '05 dodge ram dually 2500 diesel. He'll let me have it for $32,000 and will give me $23,000 for my '04 XE. I'm pretty happy with that...and kudos to the dealer buying it back. I don't think they knew about it. I know they are going after the original owner who traded it in, for fraud.

I dont know to much about these kind of situations, and chances are the truck could run great for many years to come but 27 or 28k is just way to much for a vehicle that sustained 11k worth of damage.
About a year after my dad got his brand new 01 supercharged crew it was tboned by a car that ran a red light, and it must have been a very small car because when i went to go look at it, it apeared to have minimal damage as the nerf bar seemed to absorb most of the impact and both doors had minor scuffs. The car also destroyed the front rim cosmetically and tore the spindle up.
Truck had about 20k miles at the time.
It ended up costing about 8k to repair and they ended up repainting both passeger side doors and now with 98k on it, its still drives just like new and unless your a professional body repair person you cant tell it was hit.
I thought we were going to get rid of it but he decided to keep it and its been a great truck with no problems in its 98k life.
27k is still way to much for a truck with that much previous damage and i would do whatever it takes to get a refund. Im not sure how yours was equiped but i know some brand se crews can be had for that price.
Truck had no frame damage which i was impressed with seeing as how the nerf bar was sitting beside the transmission!

I am very jealous, went to trade mine in at SAME dealer I bought it from for an '05 SE 4x4 and was offered $18,500 with my upgrades which I thought was GREAT!
The highest offer I got private party was $20,000 (oh, I have 15k miles) to include exhaust, intake, front lift, grille, wheels, power locks, alarm, etc...
Use the refund to purchase an extended warranty through the Nissan DEALER
4) Purchase the Nissan dealer minimum maintenance plan and diligently use their maintenance
To those that said for him to buy a extended warrenty,or even the orginal factory warrenty, you need to closely read some of the fine print in your warrenties, there are clauses written in them that the repair or repairs will not be covered if failure was do to an accident, take the transmission for example, if the casing is cracked, they'll look into why it cracked. the rear end starts to vibrate, and the housing/ or axles is found to be bent..hmmm now how did he bend those axles????
another is that this truck was "fixed by Nissian" and its history is in the system via the vin.
See my point on this? I'm not flaming anyone but just pointing it out.
WOW, AWESOME!!!!! I'm SOOOOOOOO glad to hear it!!!! Glad to hear that they stepped up to the plate and made it right. The first owner should be held accountable for not disclosing that the truck was wrecked, that is plain FRAUD!!!

Glad to read that the truck is gone but....
I bought my 2005 LE Crew Cab 4X4 in Feb. for 32K with zero miles. With rebates etc. you could probably get a new one.

You have two choices in life:

I would not consider it fraud to trade in a vehicle without disclosing an accident like that. I would feel like a $hitbag if I traded in a truck that looked like it had airbags but didn't... or something like that. But I would consider that just an inherent risk of buying a pre-owned vehicle.
That is awesome, though, that they "unwound" the deal and I would be a loyal customer and overall "fan" of that dealership and their management; but I would consider myself very lucky at the same time.
also, the DMV does not report anything to CARFAX. CARFAX is not a governemnt entity. They are selling peace of mind, justified or not, for a profit and nothing else.
oh yeah, one more thing: in Nevada and Texas you only have to sign an affidavit that the mileage expressed by the odometer in the vehicle is accurate and you have not tampered with it. You do not sign "that you promise it was never wrecked" that would be a joke and an unnecessary intrusion of government into business.

Its Fraud because they SPECIFICALLY ask you to disclose exactly that (accident, etc.) and make you sign a "disclosure agreement."
I would not want to admit either, as it severely lowers the value of the vehicle, but it is fraud if you sign a document that you were never in an accident, and come to find out that you lied and $11,000 worth of body and mechanical parts were replaced/painted.

I think it's fraud. But also, they don't make you promise it was never in an accident...they ask you if you are "aware" of any minor or major damage to the vehicle caused by an accident. You answer Yes or No. Now, had I not found out about this damage and decided to trade it in on an LE...I would have honestly answered that question "NO". But this guy was the original owner and had to know.
the dealer TOLD me they were going after him for fraud. I don't know this for a fact, nor do I know if he disclosed it or not, nor do I know if the dealership even presented him with paper to sign. They're supposed to by law but maybe they forgot or maybe they checked their paperwork and he had said "YEs" and they knew they were toast. Who knows? I'm glad they are taking care of it.
The cheapest New '05 in Fairbanks (only 1 dealer) is around $34,500. But the one I'm getting has the DVD package (which I could care about) Big Tow,...pretty well loaded up w/only 2500 miles. Like I said, happy to have it.
One other thing....I would tell...especially now. If you don't someone else is gonna take it in the shorts without full disclosure. That's just not right...fair is fair. If you wanted to send an anonymous letter after the fact letting the dealer know the car had $11,900 worth of body work (if the dealer never asked you) at least you would be saving some other poor sap a lot of heartache.

Glad to hear it is working out... just a thought on your prospective truck... I paid 31K for the same Titan, NEW.... LE CC 4X4, big tow, maybe other stuff... basically everthing but nav, dvd and sunroof.... I don't know the market at all on the used ones so if your trade deal is great then it all may workout....
Doesn't CARFAX have some sort of guarantee about the accuracy of their reports? I thought I heard that they'll buy the vehicle if their report is erroneous...
That is correct, but some information does not eventually get to CarFax.
They do not actively seek the details on a vehicle unless they're notified to do so. In this case the owner may get lucky and the C-Fax stays clean.
If so, then it's up to the owner to report any previous work to prospective buyers in the future.
It is true, however, that the resale value would take a giant hit. In my experience at the auto auctions, these vehicles go for much less than their non-damaged counterparts.
So if you're trading it in, watchout! They'll know in a matter of minutes that it's been repaired and painted. If you need to take a minor loss and return it, do it before it's too late and go with a brand new one.

Carfax runs an ad on the radio every afternoon here. It is a guy (monotone sounding like a MIB type) ringing a lady's doorbell and telling her he is buying her car back. Why she asks. And he says because Carfax missed a major accident for the vehicle and therefore they are buying it back from her.
My guess is the dealer will be covered by carfax and they will come out okay as well. It was nice of them to make it right by you (even when it was something they didn't know up front), a honest dealer is hard to find, hold on to him. Glad it turned out okay.
