I almost killed a man Friday...

...we went to So Cal for a vacation, drove in Friday...

was parked at a Chevron station at the phone booths to find a car wash to clean the bugs off my 3 month old Titan LE CC Galaxy...

I get back in the truck, my family waiting inside...

I just about put the key in the ignition when...BOOM!

some idiot in a Camry reverses and broadsides my passenger side at full speed...

I say, what the...

step outside, an older 50+ man gets out of the car, and says, I didn't see you...

How can you miss a Titan right behind you?

It's not exactly the smallest thing on the road...

that meant, he just didn't look when reversing, and fortunately my son didn't get out of the passenger door during this stop or he would've been killed...

turns out, its his nephew's car...



I hold my temper and get his information,

he essentially bashed in the rear panel, the frame behind the rear passenger door and the rear passenger door...

I guess my one saving grace is that the other vehicle has insurance...

boy is his nephew going to be in for a surprise...

3month old titan, that just plain sucks. sorry to hear about your titan. it could of been much worse, be glad it ended this way and not any other way.

Sorry for the crappy accident, I would have gone ape ****. If you get a chance and are able can you post some pics ? I am always interested in seeing what kinda damage the titan has after any bump or smash.

I'm pretty sure he hit my rear wheel too...

would that cause any damage that would result in faster wear in the future?

You done good by not losing it. That only creates more problems. Sorry about the truck and I'm glad the family is OK.

Just hope that the insurance his nephew carries on the car will allow him to be covered. I had an accident several years ago when I hit a guy coming out of a private driveway, he was cited for failure to yield right of way, and I attempted to file a claim against his insurance and was told the insurance was in his wifes name and there had been a waiver placed on the insurance that whenever he drove the car, it was not insured. He basically was able to avoid getting cited for no insurance, but I had to file under my UIM portion and was out $250 for my deductible. And on top of that, the idiot tried to file a claim on MY insurance. My insurance tried to get restitution from him, but ended up writing off the $4800 they spent to fix my car. Anyway, hope this doesn't happen to you. Glad to hear the family is ok

Wow, Jollysammy, same thing happened to me when my Titan was three months old, someone not looking backed into my Titan but my damage was less severe, still a PIA. I know exactly how you felt. . .

Beware, stories change once they talk to their own insurance agent, some how they will try to make it your fault, e.g. were your lights on, were you parked legally, etc., etc.

Hope everything gets repaired soon.

latest update...

the owner of the car, the driver cannot be reached...

they have not responded to letters and phone calls from their insurance company or mine...

so liability cannot be determined until they contact Farmers...

fortunately for me, they have 17 days to do so, not forever...

I'm wondering if they think they could ignore it and it will all go away...

I'm thinking that I should pursue my diminished value case after they have let the time lapse and the insurance companies find them totally at fault, then I'll try to pursue the diminished value case in small claims court, does that make sense?

Depends on how much time, effort and angst you want to spend on this.

You won't teach him a lesson, he's beyond any education besides a good swift kick in the nads.

Let your insurance handle it, get your truck repaired and be done with it.

Let me give you some advice on the repairs. The Dealer wrecked my truck w/ 3000 miles on her in the same area. You can see pics, just search for "Help - Dealer wrecked my Truck". Anyway, have them replace all the skins and not just bondo. Insurance companies hate it because they know for sure it will crack in the future. As far as the back door brace, they will have to cut it at the top of the cab and at the bottom by the step. it will require some bondo there, but thats it. If you look at the pictures of mine, they tried to repair it and the door is now wavy and the door brace is already cracking. The dealer was willing to negotiate, so I'm getting a new vehicle (not for free), but it did take some heavy handedness w/ an attorney. Hope this helps!

id be severly pissed if someone crashed into my car after only 3 months but even moreso if he couldnt be contacted. i hear you when you say you want to get the diminished value and take the guy to small claims court. it sounds like you'll have to find him first...haha.

did you get anyone that was there and witnessed anything to help you out. maybe some official statements from anyone? that would help out tremendously, especially if you intend to sue. im no attorney, i just watch Judge Judy/Mathis/Brown every day...hahahaha

they accept full liability for the accident...

now, about getting it fixed...

do I go with my State Farm repair shop or

go with Farmer's...

You can go to ANY shop not just the one listed by Farmers or State Farm. Find a reputable shop, just because it's listed as prefer by insurance company does not make it a good shop. Happened to me before on a previous car, I had limited experience with accident at the time, let a shop that was listed as a prefer shop by my insurance carrier, they did a POS job.

Go to a Nissan dealer for repair...That way all your bases are covered. If there are problems in the future, it's the dealer's problem...
