I'm asking for help if anyone has gone through this before.
I took my truck in for her first oil change, and got a call at the end of the day telling me they need to send it to the body shop. A kid was hot rodding it, and tried to make a 180 degree turn into a wash bay on a 10' radius.
From the drivers side rear door handle (Crew Cab) all the way back to the rear 1/4 panel was gouged. It was about 3' long, 8" wide and about 3-4" deep. Said they would do the right thing, but after a month they're now saying, Sorry, here's your Truck back or I can trade it in on a 2006 and pay 5-10K difference.
I've already started the attorney route as I was sitting in the GM's office. Was wondering if anyone else has gone through this before, and how did it go. Also, has anyone traded up from one year to the next and what was the difference you had to pay?

What do you mean they are saying sorry, here is your truck back. Did they fix it??

I recommend that you go ask your attorney and settle this fast.
Or you can go to small claims court and settle this fast
Or call 1800-nissan1 and tell them about it.

Not yet! They told me all along, they would get me a new truck. They sent the truck to a body shop, they told them how to repair it, etc. I knew where it was, but didn't pay too much attention because everyone including the GM was telling me that they had to fix it anyway to resell it and that they would be looking for me a new one. Because of the options I have on mine, I had to order my 2005 and it took 5 1/2 months. They new how picky I was and since it was pristine when I brought it in. Since they couldn't find another 2005, they said they would order a 2006. Now, just today, their backpeddeling and saying "I'm only obligated to repair your truck"
Why don't they just fix it up and be done with it. Honestly doesn't look like a big deal and should be an easy fix. I would just insist they make it right and move on. Maybe negotiate an extended warranty out of them for your trouble or some other goodies....xm radio, remote start...???

I'm with the rest of these guys. Don't take anything less than a brand new truck with the same or more options than you had to begin with. Fixing this damage doesn't fix your resale value, and there's no way to tell how much they need to compensate you for that. Keep up updated!

I'm not sure if it's a TX only law, but anything over $500 in repairs must be reported to whenever the vehicle is sold or traded. Your truck would then be worth wholesale. File a lawsuit for a new truck. This is gross negligence on their (the dealer/company) part and you should lose nothing as a result of that.
I settled out of court when I got plowed in my F150 many moons ago due to the fact that the driver of the other truck was working at the time, in a company vehicle, had no driver's license, and was an illegal alien. I had to settle for taking the truck back "fixed" - it was still twisted. It took over a year but two days before the court date and a couple of threats by the insurance company that I'd lose and have to pay the court costs, they broke down and gave me what I wanted.

Did you get anything in writing from the dealer about them promising you a new truck? If not, talk to your attorney and get the ball rolling immediately on getting you a new truck! There is no excuse for what they did!

I honestly can't even believe this ****. You should get the person's name who did it, go over to their house and kick their ***. That is absolutely ridiculous. Sue the dealer for everything they have and a brand new decked out LE crew cab 4x4.

I really don't want to admit this...but I used to own a Dodge Durango. Took it into the dealer for, what else, brake issues, and the tech wrecked it during test drive. Messed up the front a bit. Was about a year old with 11K on it. Any way, they gave me full retail value for the Durango, which was close to what I paid for it and sold me a new one for the same price as the previous. Ended up costing me about $1000 to drive the old Durango for a year. I was happy with the deal.
