contract question

In the state of Texas if you give a dealership a check ($500.00) to order a car that you will not get for about 7 days. Can you change your mine and get your check back? Isn't there a law in Texas saying you have 48 hours to return a car if you change your mine? This one is stilll just on order.
My father went to the Toy-screw-you dealership and order a car for my mom on Saturday. I did some checking and can get the car for about 1600.00 dollars less. I tryed calling him at the dealership on Saturday, but for some reason they were not able to page him.
My dad is 70 years old, and the car salesman, pulled one over him.
My dad keeps telling me the salesman was a really nice guy!!!

None - the minute you've signed the contract, the vehicle is yours. "Buyer's Remorse" is a myth pertaining to the buyer's supposed legal right to change their mind and return a vehicle after signing the contract. Not at all based in reality! This myth probably stemmed from a stipulation called the "Right of Recission" when refinancing a home loan, which allows the person refinancing a three-day "cooling off" period after signing the refinancing paperwork to change their mind and cancel the refi. This IS true and does exist (for refinances only, not home purchases). With regard to vehicles, clothes, jewelry, or anything else...nope.

I don't live in Texas but can tell you in Oregon, there is a 3 day period after you sign any contract to get out of it. Especially since you haven't even got the vehicle yet, you can absolutely get your money back. The dealer should be embarrased that you found the vehicle for $1600 less somewhere else and offer to work something out with you. I don't know about laws, etc. but there is no way the dealership wants the publicity of screwing over a 70 year old man.

You should try the nice approach and see if they will work something out to get closer to the price of the other truck you found... or if that doesn't work or you don't even want the lesser price truck, play the 'taking advantage of a 70 year old man' card. I just can't imagine any business wanting that hassle.

Around here the car dealers are pretty afraid of the state attorney general. They are always riding a fine line between legal and not and really don't want any calls to them that they can avoid. If you really want out of the deal bad enough, you can get your Dad his $500 back.

The piece that is missing here is that I don't see where he says he signed a contract. Dealers often require a deposit to "get" the car for you to ensure that you will buy it.

If you didn't sign anything and only gave them a deposit, they cannot keep it under any state's laws....there is no contract and since you are asking, no discussion of a refund if you don't purchase the vehicle that is being ordered.

This happened to me on my first new car, except they kept screwing me over on the delivery date. Called the salesman and said I wanted my car or money in 1 day. The next day went to the showroom when it was really busy and asked for my money back, and the salesman got really sh1tty w/ me! So... I had to start raising my voice to let all the customers hear what an arse this guy was. As soon as the "conversation" got loud enough to make the other customers take notice, the manager came over and drug the salesman off the floor. A few minutes later, he came back w/ my check, still wanting to argue w/ me! See if they will match the price, and if not, you could try this. They really don't like it when perspective customers get a good earful of how they really opperate. Whatever the outcome, good luck!

Yes, He did sign a contract and gave them a 500.00 depost. The salesman knew what he was doing. I may call DOT Today and see what they say.
