Dream to nightmare

From this...

New Titan owner

to this... (see attachment)

A motor grader (Caterpillar 14h, approx 32,000 lbs) hit my Titan at 6:30 AM Friday 1/12/07. The Titan was parked, no one inside.

The damage is so bad. The impact was on the front, but... the tailgate doesn't close any more. The Nissan logo on the tailgate fell off.

What am I going to do? Besides

OUCH! That really sucks.

If they do total it, make sure they compensate you properly for your options and trim line. Lots of times insurance companies will improve their payout after you bring the additional options in a totaled vehicle to their attention. A friend of mine even got his payout increased because he had just put new tires on his car that was totaled.

Same thing happened to my buddy last year, so he bought himself a Titan.

In his case, his car got mashed. The equipment owner fired the operator that munched the cars (in this case there were 3 cars), gave my buddy fair market value for his car, made the last 3 payments for him (1500 bucks), and had the crushed hulk towed away.

Long story short, we went down and bought him a Titan. I looked at it and said "nice truck". Went out and bought one just like it for myself.

Thanks for the replies. This sucks so much.

I paid cash for this Titan, approx $38k. Added XM, Truxedo and a brake controller. So I'm in ~40k. From my perspective its still a new truck, with only 24k miles. From the insurance company's perspective *if* they deem it a total loss, they will only cut me a check for Fair Market Value.

Lets say FMV = $28k. A new comparable Titan = $44k. If I sue the operator of the motor grader *and* the Home Owner's Associaiton which owns the grader to plow their roads, will I be able to recover the $16k which I feel I'm due?
