Well, after fighting Ford for almost a year now over my transmission I've received the verdict this weekend. Ford will have to buy my truck back under the Texas Lemon Law. I will be awarded very close to what my original loan was for. Ford also has to buy back my extended warranty and all the accessories I added to the truck except the toolbox.
I think the videos I took of my transmission not shifting correctly is what ultimately helped the administrative law judge make the decision. On the hearing date I had 36,289 miles on my truck. The judge deducted 11,738 miles from my settlement for the reasonable unimpaired amount of use I did get out of the truck. I had 24,551 miles of impaired mileage that was calculated at a lower rate than the unimpaired mileage. I currently have 45,000 miles on my truck.
I don't think I'm coming out that bad in my settlement at all. I got to drive a new truck and put 45,000 miles on it and still get back nearly everything I put into it.
The problem I had was with a transmission grind/shutter during the 1st to 2nd gear shift that seemed to only occur at light throttle while driving in stop and go traffic. It seems to be temperature dependent also. The hotter it was outside the worse the problem became. Ford is aware of the issue, but they claim it won't cause any longevity issues. I have the documentation from Ford to back this up. It affects all 05-06 F150s with the transmission that goes with the 5.4L engine.
This is Ford's response at my Lemon Law hearing.

4R75 Intermittent firm 1-2 shift - May be characteristic depending on drive conditions - Check DTCS, Verify Fluid level and Condition:
Some 2005-2006 F-150 and Mark LT trucks with 4R75 transmissions may exhibit an intermittent firm 1-2 shift. This condition may be aggravated by low speed stop/go driving in city traffic (speeds 20 mph or less) and higher ambient summer temperatures (85F and above). If the customer reports the issue under these operating conditions, it may be characteristic and is not a durability issue or any type of indicator of early transmission failure. Verify that the fluid level and condition are ok, and attempt to verify that the customer's concern is only present under these conditions. If the customer concern can be duplicated under other driving conditions follow diagnosis by symptom charts in the work shop manual. If the customer's concern can only be duplicated under the above conditions do not attempt repairs.
I've always liked the Titan and hopefully I'll have one in my driveway sometime soon.
The power and amazing tranny in the Titan will capture you...if it hasn't already. Sorry about your F-150, you'll be happier now.

I test drove an F-150 FX4 with the biggest available 8cyl 2 days before picking up the Titan, just to be sure.
..........I looked at the salesman and said "Are you serious? Should I get out and push?"
I love the engine and transmission in the Nissan. The tranny doesn't BS around for a few seconds to decide what gear to go in like the Ford. It just shifts and goes. At the time I wasn't ready to purchase a truck that hadn't been in the market that long, but looks like you can't even count on one that has.
I was considering the Tundra, but I was able to rent one for a week and it's not nearly as fun to drive as the Titan. It seems to have more power especially at higher speeds, but the Titan doesn't feel as big and heavy in the handling department. I'm sure the Titan can hang with the Tundra in acceleration with a few mods.
memsu: i have to agree with you, i also had a a rental tundra for a week and didn't like the feel cuz it was heavy, bulky, and especially wasn't fun too drive.
i feel in love wit the titan when i first bought my 06 titan. now i have upgraded to an 08 pro-4x. loving it every minute of it, except for the gas mileage. what do you expect, the power of the v8. hopefully you make the decision of buying a truck that you'll like. everyone has thier own opition. good luck in you decision...

Well, my Ford only got 13.7 mpg on the highway anyway. So, I definitely know what to expect. I use the truck to work out of town 4 days a week. I've put 45K on it in a year and a half even with all the times it was in the shop and I even made efforts to keep miles off of it leading up to my hearing.
I actually think the F150 handles better than the new Tundra. The F150 is one solid truck except for engine and transmission. But, you can't half *** the heart of the vehicle and expect me to get another one.

i know it will be hard to loose sumting that you had a long time and put effort to it. let me clear this up, juss get a truck that you like, i'm not trying to persue you to get into a titan, but get a truck that you wouldn't regret. it is hard to decide. good luck in your decision...
Here is a link to one of the videos I used at the lemon law hearing. You can clearly hear a grinding noise in the transmission. Ford considers this normal, lol.
Well it does affect you because I also fought Ford hired an attorney and was told I didnt fit in the lemon law because a neat loop hole for ford was if you buy 5 or more of the same brand you are considered a commercial owner just like a company fleet. Ford wouldnt buy the truck back but would take it in on trade which I did cause that truck was a piece of ****. Kept sucking fuel into the cooling system and the diesel fuel was eating all the seals in the motor.
To be quite honest, every brand has it's amount of vehicles with problems.
Even if you bought another F150, you'd probably be just as likely to have more problems as you would were you to buy something else such as a Titan.
In case you're worried about a repeat offender with Ford...buy something else.
Test Drive the Tundra again, then the Titan, another Ford....a Dodge....GMC and then a Chevy.
Hell, test drive the Honda truckwagonvan they have out.
Don't buy based on which one will give you problems; buy based on what drives best of those you test drove.
You're probably not going to know how elite your choice is unless a friend owns something and you've witnessed what it can do first hand.
Good Luck in your hunt for a new vehicle.
I'm not a Chevy/GMC or Dodge fan. So, that pretty much leaves the F150, Titan, and Tundra. I've driven each one extensively and the Titan is hands down the most fun to drive. With the current rebates the Titan is looking pretty good.
