Just like many of you, I too have grown tired and frustrated with my Titan. I love the power, blah, blah, blah, but I can't stand the fact that my truck is having a different problem literally every week. Regardless if it's a 1st year model, when you >$35K you shouldn't have these types of issues. At any rate, my question is this: the Florida law asks the question "Have you taken the vehicle to the dealership or an authorized service agent at least 3 times for the SAME substantial defect or condition or has the vehicle been out of service for at least 15 cumulative calendar days due to one or more substantial defects or conditions?" How or would this apply to all of those times the dealerships state "cannot duplicate" and would these times be counted? I wouldn't think so, so what is our recourse at that point? And what is considered "out of service" do you have to be without your vehicle for 24 hours or does 6 hours in the shop equal 1 calendar day? Any ideas?

I am in Florida, and today I just send the papers to Nissan and to the Attorney General in order to open a "Lemon Law" case file.
My truck was three times at the dealership for the "fuel gage showing full" problem. Twice out of 3, the service people were not 100% clear about what they did. Of course the service dept is always closed when I pick-up the truck after work. Basically it is hard to talk to anyone, even on the phone. I am ususally put on hold, or the message box is full.
They don't know what to do basically. They told me to bring it back again (4th time). They won't have the part in stock I bet, and I'll have to bring for a fifth time.
Heck no, enough is enough!!!!
As far as I am concerned, I have had the truck for 2 months, and the problem has not been fixed. Like you, I paid hard earned money for the truck.
Filing these papers will get Nissan's attention in any case. I was told by the sales manager that when one does that, Nissan sends a tech adviser on site.
What do I (and you) have to lose by opening a case file?

I just contacted the attorney general today in North Carolina .and am waiting for the paperwork also.......I also want to know if part of a day say 6 hrs. counts as a day.....and can you go twice to your dealer and the third time to another dealer for the same problem???? This may help us somewhat. We paid good money to NOT be part of a BETA experiment. That is why I want NISSAN to buy my 04 KCSE back and get an 05 if they are better now. Even an 05 will be a gamble......and in 06 they will probably do away with the Dana 44, the brakes, the radios, Japanese transmissions,
tilted dashboard etc. etc. If mine worked perfect I'd be satisfied...but I only got week #1 then the bugs really came out.built in 5-21-04. Probably 1-3 months too early.

I don't know what part of Florida you are in, but it sounds like you are getting more than your share of crap from the dealership. Have you tried another dealership? I don't know how far you are from Pensacola, but they have a wonderful dealership that strives for Customer Satisfaction. The name is Sandy Sansing Nissan. We have now bought 4 new Nissans from him because of the customer satisfaction rate and most importantly the service after the sale. This is a Navy town too, and many A/D sailors bring in their Nissans bought in other parts of the country for service. Many of these sailors turn around and purchase from him because of the CS, and some will drive all the way back to Pensacola just to do business with this dealership.
I'm can't promise you he can ease your woes with the truck, but he will make sure you feel that your problem is his also, and having a good dealership who's on your side always helps.
I'm not in Florida, but Massachusetts. I know I just filed papers for my vehicle being out of service since Nov. 30 for the rear differential. Massachusetts considers a day 24 hours. Regardless, Nissan has till the 27th, of December and then I will become a real pain.
The funny thing is that Nissan received my 7 day warning letter in Friday. I would've expected them to get back to me today. But what do I know, I guess they really don't care. That's OK, I'll spend $40,000+ of their money in the arbitration process. Let's see already at about $1200 with the rental and tow as of today.
Sorry had to vent a bit.
If you guys are interested I opened a claim with the Better Business Bureau Autoline. They'll accomplish things quicker then the State Arbitration process (at least MA). PM me if you want the number. They say 40 days or less to have it settled.

They are bringing in the USS Iwo Jima in here as a reef wreck. We already have the USS Massachusetts as a wreck just outside the pass in about 80 ft of Water. Even though there is low vis here, Fishing of all types including snorkel abounds here, not to mention this is the home of the world's most beautiful sugar white beaches. Come up sometime, you won't be disappointed. Last year I shot a 18 pound grouper on a Hawaiian Sling off a wreck.

I still have three stains-less steel ahwaiian slings from my sailing days..they are my favorite to spear fish with. My favorite part of the grouper is the cheeks....taks a good size one to make more than a bite. Happy spearfishing!
