Exclamation Voided Warranty

I just bought my 07 Titan LE 4x4 last May. Before taking it in to have a 6" Pro Comp lift put on, I asked about voiding my warranty by lifting it. Both the dealership AND the lift shop said I would not void anything. Low and behold, four days ago, my Rack & Pinion had a complete blowout! I limped the truck to the dealership, not too worried cause the truck only has 11,928 mi and is 10mo old, I was expecting a no hassle fix. WRONG!!!! The dealer (Folsom Lake Nissan, Folsom, CA) told me I completely voided my warranty by putting in the lift and I would be looking at about $2500 to fix it outta my pocket! I argued with them telling them that a factory part should be taken care of under the warranty! They still shot me down. I called 4wheel Parts(the lift shop) and was told I was protected under the Magnuson-Moss Act. So at this point, I'm calling back and forth and getting nowhere. I called Nissan USA and they seemed to be behind me. Its been since fri and I havent received any news cause of the weekend.

I'm wondering if anyone out there has had any similar issues and the outcome you had. I see a lot of good looking Titans with lifts, so I figure someone has had a warranty issue with the dealers. Any help???????

Re: Voided Warranty

I am not sure of how it works exactly but I am pretty certain you are covered. There are other guys that will chime in and fill you in for sure. I know that there is a law that protects us and in order for the dealer to deny your claim they must prove that your aftermarket part was the direct contributor to the failure of the stock part. Tell them you will have your lawyer contact them and that might put them in shape. Good luck, let everyone else chime in though.

Re: Voided Warranty

maybe this should be under dealer service..I just got done fighting with my dealer about the 142 point Nissan inspection they didnt do. But claimed all was good. Wish you luck man..be ready for alot of phone calls and "you need to talk to ......." "let me transfer you." I wish you luck. I have read on here plenty that your warranty wont be voided.

Re: Voided Warranty

It should be covered under the law as long as the aftermarket stuff had nothing to do with the failure. But, you are still at Nissans mercy no matter what anyone here or elsewhere tells you. All of us put together do not have enough money to fight them in court if they dig in. I personally dislike all these after market people who hide behind the moss/mag law. They run scared when you need them most, but sure are willing to take your money as they reassure you that you will be just fine if you have any warranty issues. Not. I hope it all works out. I know first hand that Ford has gotten really bad about this kind of stuff.
Terry

p.s. Try real hard to stay on the good side of all you deal with at the dealer and nissan, trust me, the nicer you are, the more willing they will be to help you, and do not quote them the law.

Re: Voided Warranty

Different dealership is in order ... Aloia's FLN are a bunch of losers IMO.

Last time I was there they told me I needed a need air filter ... I had changed it myself 2 weeks before. They said well it's dusty out were you live ... it had been raining the previous two weeks.

Maybe try Elk Grove or Shingle Springs ... Idk ... Good luck, and remember Calif. small claims court is up to $5K, and no lawyers allowed.

Re: Voided Warranty

Your warranty will not be voided for the entire vehicle. If it can be proved that something you installed has damaged an OEM part, then just that portion of your coverage could be in question.
ie:how were the bump stops set when lift kit installed?
Pro Comp sets these for a safe limit but the turning radius sucks bug time,a lot of guys modify these for better turning which in turn damages the steering rack end seals. This is MUCH more common on the Fabtech lifts then the Pro Comps though.

Re: Voided Warranty

They can't void your warranty, but they can deny your claim on the affected part if they relate it to aftermarket. In this case, the steering rack can definitely be affected by a 6" lift and larger tires and wheels. Your dealership has no say over what is covered. They can choose to "overlook" certain things but if they get caught by Nissan I am sure it isn't pretty. Your installer lied to you also if they told you Mag-Moss would cover this. Mag-Moss is to ensure manufacturers allow aftermarket replacement parts (oil filters, shocks, airfilters, mufflers and so on) to be sold other than their own. A lift kit is not a replacement part in this instance, it is a modification. It is pay to play unfortunately. If you had a problem with say, your raditator you'd be all set as they could not directly link it to your lift.

Re: Voided Warranty

Don't forget the ProComp lift is part of the NISSAN endorsed "No Fear" package.

Re: Voided Warranty

Unfortunately it is also the Nissan installed NO FEAR package. That could be the rub.

Re: Voided Warranty

As Smoke05 said, the MMA is there to allow owners to use parts other than OEM but they must not change how that OEM part worked....oil filters etc. Nissan will only deny warranty work for effected parts...not the entire warranty. A 6" lift and larger tires can/will get warranty work denied on most driveline componants because they add more stress (no ALL componants of course) than the driveline was designed for.
The easy way out would have been to remove the 6" lift before going to the dealer.

Good call Yello!!! I forgot about the NoFear Titan!!!!!!!!! That helps! When all is said and done, I think they would look like a huge bunch of hypocrites if they sell a lifted truck on the showroom, but dont back a customer who uses the same lift on their own!

Which is a dealer installed option, not factory. I guess it works the same way as anything dealer installed. Any dealer installed accesory is covered under the warranty. But install it yourself, and it's not.

Re: Voided Warranty

You said you spoke to the nissan1 phone rep. If Nissan is behind you, thats what matters, the dealer is only a Nissan rep. Get Nissan corporate to say yes and then the dealer does what they are told. I did this with Ford years ago and got 4 free tires plus an alignment when my dealer said "they'll never cover this". Yeah right.
If they make the no fear componants they can't get out of this.
Good luck.
