I was in a small fender bender a couple of weeks ago and noticed on the corner plastic piece of the front bumper, that there was bondo chipped off instead of paint. I took it into a body shop and asked them what they thought about it. The shop said that it looks like it has been in some sort of accident before and also that the right fender looked like it had been repainted. I just bought this truck NEW in July, granted it's an '06, but was still NEW! I've talked to the dealer about it and they say that their doing some research and really seem like they want to help figure this out. The dealership also said that any damage done that cost under $500 they don't have to disclose. But on the other hand if it's over $500, then they do. I really would like to see the law on this, but have no idea where to start. I really don't know what my options are either, I would really like some advice. Thanks in advance.

Laws vary from State to State.
I would contact your state's DMV.
They should have the answer.

Check the Attorney General website for your state. Or give them a call. They should be able to point you to the relevant applicable laws. Especially if you tell them you have reason to believe that a car dealer has committed fraud. This is a state law issue, so the answer should vary from state to state.

Kronos, not a bad idea, but if it was sold new, there won't be anything on it.

carfax will only show something if it was done on an insurance claim of some sort or the dealer actually put it down by vin.

If you can get a shop to say it was repaired it shouldn't be much work to get the dealer to give you a new painted bumper since you bought new.

the dealer is wrong! the law says that the dealer must disclose the damage to you. The $500 is for when the vehicle is damaged during delivery to the dealer and the manufacture doesnt have to disclose it to the dealer.

new just means you're the first to register the vehicle. with regards to car accidents in california, you do not have to report anything to the dmv if it is under $500 and no one was injured. not sure if anything would be on carfax if someone paid out of pocket. not sure if dealerships are held to a higher standard either.

I've tried getting them to get a new truck. didn't happen. So I'm now trying to get the off-road package put on w/ new bfg's. I spoke to them on Thursday, but I haven't had heard back yet. That package was the only thing that I didn't get, that I wanted. So we'll see what happens, the tires alone would saev me a grand.
