I was driving my 2005 Titan CC 4x4 on a 75 MPH highway towing my 20 foot flat bed trailer loaded with hay bales traveling around 55-60 MPH in the daytime. I saw a 2014 Impala coming up behind me very fast - 2 lane road - so I eased over to the right of the lane thinking he was going to go around me to the left over the double yellow line. Long story short - he tried to pass me - ON THE RIGHT SIDE! He made it past the trailer - but caught the side of his car on my Iron Cross front bumper when he went to cut back in front of me. Thank all that is good I was able to stop the truck when he spun out in front of me. The whole side of that 2014 Chevy Impala is done. My right front fender - new angel eye headlight - right front wheel - and the Iron Cross bumper caved in and twisted. Truck now goes down the road a bit crabbed with the steering wheel clocked 1/4 turn to the right. He has Progressive Insurance. I have State Farm (I still have collision on the Titan with 500 deductible) I spoke to my state farm agent and got the accident report from the police. My Agent said I should try and go thru his insurance for repairs so I don't have to pay the deductible. Is this a good idea - or a bad one? Also my Titan has 103K Miles now - I am sure its not worth the $ to an insurance company what it is worth to me as a working tow vehicle. So far Progressive has not returned any of my calls - 11 days since the accident. Anyone with experience with these messes? Please help.::crying::

I had a similar situation when a drunk came up behind me and nailed my Nissan Frontier.
I went through my insurance company as it was not my fault so insurance does not go up. Got my money less $1000 deductible then went after the other company for the deductible and some other assorted charges such as tow(towed my own vehicle home) and rental car.

You pay for full coverage, use it, have your insurance company go after his.

My 2 cents.

Good luck.
It took me 3 months to get all the money I was due.
Also: If you are injured at all you can usually incite a more rapid response by getting doctor bills sent in. ;-)

Insurance is so much fun... ARRRRRRRRR

I'm with emb5530 I say use your insurance, you will get your deductible back. It's your insurance's job to take care of this, it's what you are paying them for. I would drop my agent if he told me to deal with the other company. I'm not a State Farm fan to begin with. It will probably be a process and will take time, but in the end you'll get your money. You won't get what your truck is worth to you for sure, but you might get lucky and be able to buy it back if you want (if the damage didn't bend the frame) from insurance Co.

i had a hit and run a few years ago. use your insurance, and get your stuff fixed. they will go after the other drivers insurance to get any money back they can. If they are able to get money back, they have to pay you your deductible back first.

I would give your statement to both companies when they ask for it. Let them decide. I bet you won't have to pay anything. If the other insurance is the typical insurance and only pays for their client, then let your insurance fix your stuff and they will take it to subrogation and try to get money back from the other insurance. At that point your only out 500$, your truck will be fixed.

I just got mine back from an accident and i had to pay my 1000$.

I think your getting taken advantage of. If its not your fault, you dont pay. the at faults person insurance company pays
I was turning left. And the person who hit me lied in their statement. So yeah I got taken advantage of.

Policeman did not issue any tickets at the accident. Seemed like he knew the driver that hit my truck on a first name basis. Pretty common here - it's a small town. Police statement on my accident report says his vehicle struck mine while attempting to pass on the right hand side. Does not mention the double yellow line highway (no passing). I guess that would be implied.

in my experience, it pays to get witness name and contact info. anytime your in an accident. immediately ask other motorists to be a witness before they drive off and get thier contact info.

If there is any present that is.

I suppose laws vary from state to state, but hard to go wrong with third party witnesses.

You have 14 days to seek any kind of medical treatment. See a doctor asap, headaches, lower back pain etc. Your company should cut you a check for the damages minus your deductible until the other company admits fault. Once they admit fault you will get your deductible back. Seek legal representation asap, unfortunately thats what it takes to get insurance corporations to pay up. Ive gone through several rodeos now and I dont take no bs from dangerous drivers and their insurance providers. When someone hits your vehicle you suffer in many ways, both time and money are spent dealing with phone calls, shop repairs, doctor visits, etc. The settlement is usually split 3 ways between you, the attorney, and medical. Insurance companies settle outside of court 99 percent of the time because nobody wants to go there.

So he passed you on the shoulder or birm of the road?! and didnt get a ticket?
Yes - wide berm with a "rumble strip" on the right. No turn lane or anything marked there.

clearly he was driving aggressively and not even on the road! No question whose at fault.

Cops are idiots. Ive been down that road myself. its unfortunate for everybody involved.

use yours. i use State Farm.. progressive is one of the biggest pack of idiots I've ever had to deal with. make sure it's understood he was at fault, let them fight the retards at progressive

Don't worry about his lack of ticket. Insurance companies will decide between themselves who is at fault irrespective of police citations. I had a guy driving backwards in a parking lot drive straight into my car. Because it was a parking lot no citation was issued, just a description of what happened was in the police report. I turned it in to my insurance, who dealt with his insurance, and my car got fixed by his insurance. If they won't call back, you turn it in to your insurance. They will abrogate it against Progressive, who will then jack that guy's insurance.

Edit: My 2,000th post in 11+ years!

OK - I took the advice of my Titan Talk friends and after 13 days of no hep from Progressive Insurance - I called the State Farm toll free claim number. Seems I never took the collision / comprehensive coverage off it since I bought it new in 2005 - so I am covered under my own policy - less a 500 deductible. I was told it could take them several years to recover the deductible from Progressive - and if and when they do - I will get that back some time in the future. I used the body shop that was recommended - mostly because they give a lifetime warranty on the work. They said they need to take the mangled parts off the truck and put it on their frame machine - to see if it has issues - and it has suspension damage from the hit to the right front wheel. So I need an Iron Cross front bumper - Nissan right front fender - an 18" Nissan 6 spoke wheel - a set of Angel eyes headlights - because they are only sold in pairs - and possibly a new PRG upper control arm and Fox coil over (both look out of shape) - Any idea if I am looking at a total on a 2005 LE 4x4 CC ? It has been 11 years since I have been to a body shop.

Once the other company admits fault your company should immediately reimburse your deductible. My company gave me a check for damages minus my deductible, then about a week later my company reimbursed my deductible, then they collect from the other company. Your company should have your best interests, its their job to deal with the other company.

You made the right decision. Progressive SUCKS and won't pay for d*ck. You should read all of the negative reviews, people who are completely at fault, have Progressive, but Progressive won't pay up. They screwed me when my Xterra got damaged by an unmarked construction site (car-length strip of pavement removed, no cones, at night...deep hole right where the dirt met the pavement. I hit so hard that my radiator mount snapped clean off and ripped my radiator out of the top brackets). I got pics the next morning of the site, my truck, everything. Got names, numbers, the construction company's insurance. Progressive treated me like a leper, wouldn't go after their insurance, they wouldn't pay either. I bought a new radiator and had a friend put it in, all on my dime. That's when I bought the Titan. I will never be on foot or shell out for a rental ever again. I can't wait for my policy to expire so I can tell them to F*CK OFF
