If you can prove the dealer stated this, yeah you can take the truck back and get one with a tow package...Sorry so many salesmen are scumbags who don't know their own product, or don't care, just wanted to move the new truck sitting there on the lot.
But you need to arm yourself with some knowledge when shopping for a new veh, and for trucks the key word is "Tow Package" If you know that you plan on towing, why would you buy ANY brand truck without the factory tow package?

Welcome.

That is just wrong if he sold the truck and gave the impression that is could legally tow the full weight that a Titan can. Legal action could be an option. Physically the truck can tow more than it's rated for(proven many times on this site), however, it's not legal. I'd hate to see what would happen to the driver that decided to tow more than the truck was rated for and killed someone because they couldn't control the truck.

There was a thread here a few years ago that had a story about a guy towing a travel trailer(can't remember if it was a Titan) in the mountains that was over his rating and he caused an accident with injuries. The driver was liable for damage/injuries because he was over the rating for his truck. Not something I'd play around with personally.

I guess I just didnt think before I bought it but while lack of knowledge on my part is no excuse. I did tell him I needed more tow cap than the frontier thats y I went with the titan. Like I said I did tell the salesman I needed a tow package can't prove I did though now Im just pissed

And you have every right to be...Take a look at you owners manual and see what your truck is rated to pull, I suggest you get the factory hitch "kit" it will come with the same hitch as the Tow Package, along with the correct bolts and relays for proper lighting.
For 2004, a non-tow package SE or LE was still rated to tow about 7000 lbs...

If you bought a 4x4 with the Off Road package, then you would have the same tow capacity, as you would have the same rearend as a Big Tow Titan. Do you have the OR?

You have the 08? How long ago did you buy it, you may be able to exchange it since it is such a fresh deal.

I would consider a firm discussion with the dealer; salesman and general manager at same time. Make some demands since this is so fresh. See what happens, have your facts laid out in writing. The right thing for them is to upgrade you to a BT, if you aare not OR already.

And you believed the "salesman"? He is no tech. He can barely open a water bottle. Never rely on a salemans word. His last job was probably selling couches. It sucks you fell for the buy today bit and didnt do your research before signing on the line. An expensive lesson for sure. Your car is 2nd only to the house for big purchases. You need to really take your time. Just because the dealer says you can drive away in an hour with your new car doesnt mean you have to. I really do feel your pain and I hope this doesnt happen to you again. But just remember to take your time with it next time.

I believe the components of the BT package are: factory class 4 hitch, 7 pin wiring harness, tow mirrors, tow mode, and all the relays for trailer lights. Not sure if thats all of them, but I hope it helps. They shouldn't even make trucks without the factory tow package. Trucks are meant to tow and hual A$$.

So if you had to define the components of the Big Tow Package, what would they be?
1. Hitch, rated for 5000 lb pull/500 lbs tongue weight and 10,000 lbs pull/1000 tongue weight w/ a WD hitch. Pre-wired and has the plug install for standard 7 pin RV connector. Has all the extra relays for trailer lights.
2. Lower gears (3.337 vs 2.97 for non-tow)
3. Much better tow mirrors the extend.
4. Trans temp gauge
5. Bigger battery

All Titans get the aux trans cooler...
