Case settlement

So I still have my case open w Nissan and have not heard back from the arbitration specialist in two months. After countless emails, voicemails they contacted me an offered $5000 to settle my case and either aengine warranty or body/interior components warranty. This after they offered to buy back my truck for $18k 🖕🏻🖕🏻
We have lost close to $9000(payments, insurance, uhaul rental, couldn’t use boat, etc etc)
due to my truck being @ the dealer for 6 months w 2 engine swaps n paint work. Our attorney said he would handle the case and deal w Nissan if want to decline the offer. So I’m asking you guys would you take the settlement or let the attorney deal with Nissan?

The question is, will the attorney recover enough to offset his 30-40% fees? What is his best guess on total win?

Depending on how long the warranty they are offering is, you might try something along the lines of;
$12,000 to cover your financial losses/PITA factors, as stated AND both the engine and body/interior component warranties OR you will be turning it over to your lawyer.
Unless they really want to pay through the nose, because you will then be suing for this settlement AND legal costs it would be in their best interest to settle on your terms.
You might want to add that further delays or obfuscation will result in a higher amount for personal damages.
Swing for the fences, you turned down $18,000 and the are now offering peanuts.

Really depends on state as far as attorneys fees..

Its a tough situation either way. The goal at this point is to at least break even and move on.

I feel for you and sorry its at this point..

if your state allows the mfg to pay the attorneys fees if you win then let the lawyer have a run at it…
