My dealer ship is giving me a hard time about replacing my engine because the truck has the volant intake on it. They're trying to blame the intake for the engine consuming oil and they're telling me they have to do two days of testing from nissan and I don't get how the intake would have anything to do with the truck consuming oil. They have already replaced the left bank cat after 2 weeks of fighting with them. Can anyone shed any light on this matter
 
Some dealerships are like that, others aren't. I called Nissan USA Warranty Group personally and verified that they would not/could not void my warranty for installing aftermarket intakes or exhaust components before I did so - the dealership is jerking you around. The "Magnuson-Moss Act" prohibits them from refusing warranty service unless it's written into the warranty OR they can PROVE the aftermarket component you installed caused the problem directly.
You can: a) confront them with this information (google it so you know what it says), b) call Nissan USA and discuss it with them, c) find yourself a respectable dealer, or d) get yourself a lawyer and sue 'em.
 
What year model truck and how many miles???

I have had mine for a long time with zero problems....

What year truck and what's the mileage? Don't bother mentioning the "Magnuson-Moss Act". Most don't understand that it came about only so owners wouldn't be bound to OEM replacement parts. Any other part you raplace that isn't designed to act like the stock part can be questioned..they don't have to prove a thing. However, most dealerships don't bother with intakes, exhausts etc. I've seen them deny coverage for a bad MAF senson due to over oild hi flow intakes but I can't see how one would cause the engine to burn oil.
 
It seems to me that the only way the intake would cause oil usage would be if the intake wasn't filtering properly and allowed a bunch of gunk into the engine. But the oil usage would be a symptom.

Many replacement filters (AMSoil for example) claim to filter out MORE crud than the OEM filter does.
 
this sounds like the cats exploding and getting sucks back into the motor, i read some posts about that destroying engines......sucks dude, good luck with the warranty issue.
 
I would ask them in detail, how exactly the intake would cause damage to occure and how this is related. I highly doubt they'll give you a detailed reason (because they can't) and they will probably try to pick **** out their *** and you can simply aruge with them on how stupid they sound.

If they can't provide the detail, they can't prove it was caused by an aftermarket intake. This is why it's always good to keep your stock stuff around..swap it out before you head in.
 
There are many instances of this having been used successfully when warranty claims are dismissed out of hand by a warrantor.

The letter of the law:

15 USC 2302(c):

(c) Prohibition on conditions for written or implied warranty; waiver by Commission
No warrantor of a consumer product may condition his written or implied warranty of such product on the consumer’s using, in connection with such product, any article or service (other than article or service provided without charge under the terms of the warranty) which is identified by brand, trade, or corporate name; except that the prohibition of this subsection may be waived by the Commission if—
(1) the warrantor satisfies the Commission that the warranted product will function properly only if the article or service so identified is used in connection with the warranted product, and
(2) the Commission finds that such a waiver is in the public interest.
The Commission shall identify in the Federal Register, and permit public comment on, all applications for waiver of the prohibition of this subsection, and shall publish in the Federal Register its disposition of any such application, including the reasons therefor.

To the OP. In other posts you've said you put a BullyDog on your truck. If the dealer finds that out, you sure as hell won't have a warranty claim.

Hate to jump in but i thought that the BDPP was sold at dealerships now... just wondering if they sell it is there any disclaimer that says "THIS WILL VOID YOUR WARRANTY" isnt that whats on our homepage saying something about how Bully Dog had some kind of partnership with nissan. I will go re-read that.
 
You know, I'd forgotten that BD is at some of the dealers. Hmmm...that could change the validity of my statement for sure. :)

And... if they have decided accept BD tunes, can they still reject other tunes? I bet there would be a lawsuit in there somewhere if they did...

Not necessarily. Most dealers will sell you a set of Nismo headers and others will sell you a supercharger. We all know THEY are not warranty items. It says right on the box/paperwork that these items are NOT street legal and are for OFFROAD USE ONLY. But they WILL sell them to you if you want them... Some will even install them if you pay.....$$$$$

It's not about what they'll sell you. It's the old shell game regarding how they handle your service claims afterwards......

It says right on the box/paperwork that these items are NOT street legal and are for OFFROAD USE ONLY. But they WILL sell them to you if you want them... Some will even install them if you pay.....$$$$$

I agree with you BB but has anyone actually bought a BDPP at a dealership to see if it has the "Void Warranty" on it. i think that will play a role if they try to discredit the OP because of the BDPP. I had the stealership install the 7" lift, 35's and the nismo intake and true duals. When i had issues with the ABS system (light came on one morning and stayed) i took it right back and they gave me flack about having this lift on it, until I told them that they are the ones that put it on. Appearently they zip tied the ABS hose to the shocks... smartest thing i have seen in so long. As soon as the suspension flexed a little SNAP. That little piece was pretty expensive and I wasnt about to pay for it after I talked to the Service Manager and in the end I think he billed the Sales Department for the part.
 
the only way they can void the warranty is if they can prove that your being dirt or grit injected. my dad is the gm for cummins south power, he has seen it all when it comes to after market parts on the cummins diesel. they can run all sorts of test to try and prove that the after market part is causing the problem, but with that said they have to be able to prove it. i have the volant intake on my titan, at 13,000 and 37,000 miles i gave oil to my dad to run tests on it, not because of the intake just looking for problems before they start. with those test they can tell you more than could ever imagin about whats going on inside the engine. and according to him my engine was solid for what its worth my intake is doing a pretty good job at keeping out the dirt.
i'll look for the oil analysis sheets my dad gave me from the tests,if can find them i'll post them, some of you can tell more about then i can i'm sure.
if they want work with you take it to a different dealer, one that respects there customers not just looking for the almighty dollar.

You're correct about the header being for off road use only, but the Stillen supercharger is CARB approved and street legal in 50 states.
 
What I got from the Magnusson Moss Warranty Act was that the dealership/Nissan, would have to prove that the Volant Intake was the DIRECT cause of the failure and that it would not have happened otherwise.
If you just had a cat replaced because it failed(came apart), I would not be suprised if you sucked a piece of it back into the engine.
Maybe consider taking it to another dealership.
 
as i've stated more than once before, my dealer tried to blame a popping noise coming from my driver side speaker on my (ventriloquist) intake. now i don't know a whole lot about cars/trucks so correct me if i'm wrong, but that's just an asinine assessment. if they try to pull that again then i'm going to another dealer. i would suggest you do the same. GL and let us know how things work out for you :)

High volumes of air going through a plastic tube at high speed can cause static electricity. Didn't you get the grounding kit for your intake tube? LOL!!!
